TERMS AND USE CONDITIONS FOR LUGGAGETOSHIP, Inc. (hereinafter "LuggageToShip") and the Luggagetoship.com web site.
You (hereinafter "Customer") agree to and acknowledge the following with respect to any services ordered by you or on your behalf from LuggageToShip.
RECITAL:
User desires to utilize the services of LuggageToShip and LuggageToShip desires to provide such services pursuant to the terms and conditions of this user agreement and the operating rules or policies that are published by LuggageToShip.
DESCRIPTION OF SERVICES:
Pursuant to the terms and conditions set forth in this agreement, LuggageToShip will arrange and manage luggage and sports equipment shipping services. LuggageToShip reserves the irrevocable right to refuse any shipment which it deems at its sole discretion, to be undeliverable, unfit for shipment, could be easily damaged, and/or may contain possible dangerous, regulated or illegal items. LuggageToShip will make all commercially reasonable efforts to manage all necessary customer service functions and logistics arrangements, including coordination and oversight of contracted shipping and transportation companies, providing that the Customer provides timely and accurate information when available, concerning the shipment. User agrees that LuggageToShip may modify, suspend or discontinue any aspect of the services at any time without notice to the user, in which case LuggageToShip shall not be liable to user or any third party. Customer further agrees that services are subject to all terms and conditions imposed by shipping and transportation companies contracted by LuggageToShip to transport item(s), including but not limited to, any transportation agreements, applicable tariffs, other rules or procedures or terms and conditions described on such companies' websites.
SECURITY:
Customer shall maintain the security and confidentiality of the login ID and password. Customer may change password or any other account information at any time by login customer's account at AIEus.com.
RATES:
Rates generated on the LuggageToShip website are based upon the information provided by the Customer at the time of inquiry. Final rates will be based upon actual weights and dimensions of each suitcase, box or case (hereinafter each an "Item" and collectively "Items") that is shipped and will be verified during the shipment process. The dimensional weight of an item can be calculated by multiplying L x W x H, in inches, and dividing by 139.Dimensions are calculated from the widest point of each side. If the size or actual weight of item exceeds the maximum allowed by courier, oversize or overweight surcharge will be applied.Customer is responsible for all fees charged by a pickup or delivery location, such as a hotel or resort, for handling the shipment. Rates are subject to change without notice.LuggageToShip reserves the right to assess fuel and other surcharges on shipments without notice. The amount and duration of any such surcharges will be determined at our sole discretion. By tendering your shipment to LuggageToShip, the shipper agrees to pay the surcharges, as determined by LuggageToShip.
RESTRICTED COMMODITIES:
No restricted commodities are permitted in your shipment. This includes, but is not limited to:
- Alcoholic beverages, medicinal or toilet articles including aerosols such as hair sprays, perfumes, colognes, and medicines containing alcohol.
- Consumer electronic devices containing lithium or lithium ion cells or batteries (e.g., calculators, cell phones, laptop computers, etc.)
- Perishables, including food, foodstuffs, and beverages requiring refrigeration or other environmental controls, plants, pharmaceuticals. Tobacco, cigarettes, tobacco products.
Shipper need obey the local and international regulations and law.
[CANCELLATIONS]:
If customer cancellers order before LuggageToShip process the order, no cancellation fee will be charged. If customer receives shipping labels, $25 cancellation fee will be charged.If the label is shipped out to customer, the label shipping fee is not refundable. For US domestic shipment, LuggageToShip will refund the shipping fee 7 business days after the shipping date on the label. For international shipment, LuggageToShip will refund the shipping fee 15 business days after the shipping date on the label.
[CHANGES]:
Customer can change order information before LuggageToShip process the order, no changing fee will be charged. After LugggeToShip process the order and 24 hours prior to the original scheduled pick up time, customer can request change order information by phone. $25 order updating fee might be charged, plus any difference in rate. Changes made within 24hours of pick up time may be charged order updating fee of greater than $25 in addition to any rate difference.
LATE SHIPMENT:
All US domestic shipments are covered by our on time guarantee. If we have not attempted to deliver your shipment on or before your scheduled delivery date, your shipment is done at no charge. In the event that an Item is delayed, LuggageToShip will make every effort to locate the Item in a timely manner and deliver the Item to its intended destination. LuggageToShip will be in no way responsible for any losses, personal or business related, arising from the delayed Item.Shipments that are undeliverable for any reason, including but not limited to recipient not being available to sign for the delivery, shipment being rejected at destination or incorrect address are not covered by our [on time guarantee].Additionally, shipments delayed by an act of God, government unrest, or a customs delay beyond our control are also not eligible for [on time guarantee].
LOST OR MISSING ITEMS:
In the case of a missing Item, LuggageToShip will have [eight (8)] business days following the scheduled delivery date to locate the Item and notify the Customer of the status. If the Item and its contents are not located in their entirety within this time period, LuggageToShip will then proceed to gather information to process a reimbursement for up to the amount in which the lost Item(s) were covered. The actual claims process time will vary on a case-by-case basis.
DAMAGED SHIPMENTS:
LuggageToShiphas no liability for damage or loss of protruding baggage parts such as wheels, straps, pockets, pull handles, hanger hooks or other items attached to baggage. If an Item is damaged excluding "normal wear and tear," a claim must be submitted within [14 days] of the scheduled or actual delivery, whichever is later. LuggageToShip and/or its affiliates must be given access to physically inspect the damage for the reimbursement to be paid up to but not exceeding the amount for which the damaged item was covered upon proof of value. The maximum reimbursement for damage to any suitcase, bag, case or other outer container will be [$500]. Customer must retain all outer packaging used for the shipment in order to submit a claim. Packaging must conform to guidelines above in order to submit a claim.
INTERNATIONAL SHIPMENTS:
LuggageToShip will make all commercially reasonable efforts maximize the likelihood of a timely Customs clearance process and to minimize duties, taxes or other fees imposed by Customs or similar authorities.If an Item is delayed in customs, LuggageToShip will make every possible effort to correct the problem, yet customs delays are out of the realm of LuggageToShip authority.LuggageToShip will not be liable for any losses resulting from delays that occur due to Customs inspections for international shipments.At the time of shipping, LuggageToShip will make all reasonable preventative measures possible to reduce the complexity of the customs inspection process.Customer is responsible for supplying LuggageToShip with the complete contents of each Item in the shipment.(Any duties, taxes or other fees incurred during the customs inspection process will be passed on to the customer.Fees may be charged to customer's credit card at the time transport charges are captured, after transport charges have been captured, in a separate transaction, or may be billed directly from third party customs brokerage or shipping company.)Items delayed due to Customs or similar authorities during international shipments will not be covered under the [$500 on time guarantee].
LOCKING ITEMS:
For Domestic Shipments, Items traveling within a single country must be locked. Failure to lock Items will void Customer's right to file a claim for lost or missing contents of Items. For International Shipments, Items traveling between two countries must be unlocked or use TSA approved Lock as Items may have to be opened as a normal part of the Customs screening process. If Customer locks or otherwise seals an Item and Customs cannot open Item through other means, then the lock or seal may have to be broken. LuggageToShip is not liable for damage caused to locked or sealed Items that must be opened for security or Customs screening purposes. Locking any Item traveling internationally can cause extended delays and will void any warrantees expressly provided to you herein.
LIMITATION OF LIABILITY:
LuggageToShip'sliability in connection with your shipment is limited to the lesser of your actual damages or [$500], unless you declare a higher value prior to your shipment, pay an additional charge, and document your actual loss in a timely manner. You may pay an additional charge for each additional [$500] of declared value. The declared value does not constitute, nor do we provide, cargo liability insurance. In the absence of the customer declaring a value above and beyond [$500] in advance of the shipment and making the corresponding payment, LuggageToShipretains no liability for any loss in excess of its maximum liability of [$500]. In all events, LuggageToShip'smaximum liability in connection with this shipment is limited to the lesser of actual damage or [$500], unless you declare a higher shipment value in advance of your shipment, pay an additional charge, and document your actual loss in a timely manner. In no event shall LuggageToShip be liable to user for lost profits or any special, incidental or consequential damages arising out of or in connection with our site, our services or this user agreement, regardless of the active or passive negligence or sole, joint, concurrent, or comparative negligence of LuggageToShip. User expressly acknowledges that LuggageToShip is not liable for (a) any carrier's failure to make timely delivery on a specified delivery date, (b) any delays in parcels or deliveries by LuggageToShip or its carriers, or (c) LuggageToShip'sdeletion or failure to store shipping requests or shipping records. LuggageToShip will not be liable for loss, damage or delay caused by events beyond our control, including but not limited to acts of god, war or civil unrest, or acts of government. Additional value may be placed on the shipment at the sole discretion of the customer, at a rate of [$10] per [$500] in additional value. Additional value must be declared prior to the shipment retrieval date. Even with additional value declared, LuggageToShip is only liable for loss of or physical damage to package(s) at actual cash value and not replacement cost. Further, LuggageToShip'sliability is not applicable to additional costs incurred by the customer if a shipment is late, or any other costs outside of the actual cash value of a lost or damaged package(s). In no event shall LuggageToShip be liable for any consequential damages, lost profits or lost opportunity costs.
RIGHT TO INSPECT:
LuggageToShip reserve the right to inspect and open any Item shipped by LuggageToShip.
